1. Acceptance of Terms

By accessing or using SecureAdopt, including our website, embeddable widgets, forms, dashboards, and related services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Services.

2. Description of Services

SecureAdopt provides a platform that allows animal shelters and rescues (“Shelters”) to collect, manage, and communicate about adoption requests submitted by prospective adopters (“Adopters”). SecureAdopt does not make adoption decisions, guarantee adoption outcomes, conduct background checks, or verify the accuracy of user-submitted information. All adoption decisions remain solely with the Shelter.

3. Eligibility

You must be at least 18 years old to use the Services. By using SecureAdopt, you represent that you have the legal authority to enter into these Terms.

4. User Accounts

Some features require creating an account. You agree to provide accurate and current information, maintain the security of your login credentials, and notify us immediately of unauthorized access. You are responsible for all activity under your account.

5. Adopter Submissions

Adopters may submit adoption requests through SecureAdopt. By submitting, Adopters confirm the information is truthful to the best of their knowledge, understand it will be shared with the selected Shelter, and acknowledge that submission does not guarantee adoption. SecureAdopt is not responsible for how Shelters evaluate or act upon submissions.

6. Shelter Responsibilities

Shelters using SecureAdopt are responsible for complying with all applicable laws and regulations, maintaining their own adoption policies, communicating decisions directly with Adopters, and safeguarding adopter data once received. SecureAdopt does not control Shelter actions or decisions.

7. Acceptable Use

You agree not to submit false or misleading information, use the Services for unlawful purposes, interfere with system security or integrity, or scrape, reverse engineer, or abuse the platform. We reserve the right to suspend or terminate access for violations.

8. Fees and Subscriptions

Some features require payment. Fees are billed in advance, are non-refundable except where required by law, and may change with prior notice. You may manage subscriptions through your account or our billing provider.

9. Intellectual Property

All SecureAdopt software, designs, branding, and content are owned by SecureAdopt or its licensors. You may not copy, modify, distribute, or exploit our intellectual property without permission.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We do not guarantee uninterrupted service, error-free operation, or adoption success. Use of the Services is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, SecureAdopt shall not be liable for adoption decisions or outcomes, lost data or communications, or indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid to SecureAdopt in the prior 12 months.

12. Indemnification

You agree to indemnify and hold SecureAdopt harmless from claims arising out of your use of the Services, your submitted information, or violations of these Terms.

13. Termination

We may suspend or terminate access at any time for violation of these Terms. You may stop using the Services at any time.

14. Governing Law

These Terms are governed by the laws of the United States and the State in which SecureAdopt is incorporated, without regard to conflict-of-law principles.

15. Changes to Terms

We may update these Terms periodically. Continued use constitutes acceptance of changes.
